DUTIES OF CIRCUIT COURT CLERK
Court Clerks ensures the efficient operation
of state courts by maintaining dockets and records, handling
administrative matters and serving as goodwill ambassadors
to the public. The responsibilities and duties of the Court
Clerk served an important role in the operation of the court
system. The clerk attends sessions of court with all the
papers in the cases on the docket. The Clerk usually keeps
minutes of the Court. That can be done in well-bound book or
by electronic format so long as certain rules relating to
the safe-keeping of the records are followed. The clerk
deals with voluminous paperwork and the storage and
retention of documents are important considerations. When a
case is appealed from a court of record, the clerk compiles
the record needed for the appeal, and it is extremely
important that the records of the clerk’s office be well
organized and accurate.
The clerk maintains the rule docket and
execution docket in which all court judgments or decrees are
entered in order of rendition by the court and in which all
receipts and disbursements in a case are entered. The clerk
collects state and county litigation taxes, criminal
injuries compensation tax, county expense fees, funds for
the impaired driver’s trust fund, Tennessee Bureau of
Investigation fees, misdemeanant jail per diems, fines,
sheriff’s fees, clerk’s fees, witness fees, judgments,
restitution, other taxes and other items of court costs. The
clerk prepares bills of costs in cases, account for these
monies and make collection efforts when these amounts are
unpaid. The clerk collects fees for their office according
to the clerk’s fee statute and other applicable statutes.
The clerk maintains a general ledger to
account for and summarize the cash transactions of the
office and issue receipts for all collections. The clerk
often serves in a fiduciary capacity to invest funds held
for third parties. Additionally, the clerk may collect
support, including alimony and child support, pursuant to
court orders and the general law.
The clerk also writes and issues state and
civil warrants, subpoenas, show cause orders and jury duty
notification.
* The court clerk has an official duty to
attend meetings of the state court clerk’s conference unless
the clerk is otherwise officially engaged or is unable to
attend for good and sufficient reasons. T.C.A. 18-1-501 et
seq.
